Wedding Photography Terms & Conditions

In the following conditions of contract “the Photographer(s)” shall mean Madeleine Seaman trading as Maddy Bennett Photography or any photographers appointed by Madeleine Seaman. “The client(s)” shall be those whose name appears on the invoice and to be signed at the end of this contract. The due performance of the contract is subject to the conditions below. These cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer(s) in writing.


1. Scope of work

Photographer(s) shall provide photography services for the Client(s) consisting of:

a) Photographic coverage starting with bridal preparation (no earlier than 9.30am) and continuing up until one hour after the stated first dance time. The Photographer(s) will not stay later than 9pm unless otherwise agreed prior to the wedding date.

b) An optional complimentary engagement shoot for the client(s) to take place prior to the wedding date. This must take place within 20 miles of Little Bookham (KT23 3AP). Engagement shoots can only be booked Monday – Thursday.

c) Details of the wedding including date, venue addresses and times will be provided by the client(s) in writing (email is acceptable) to the photographer(s) no less than one month before your wedding date.

d) The client(s) shall provide the Photographer(s) with a meal during your wedding breakfast.


2. License and Coverage:

a) A minimum of 350 edited images from your wedding day will be provided to the client(s). The edited images will be provided as JPG files on a DVD and will be posted to the client(s) within 4-6 weeks of your wedding date.

b) The editing will consist of checking exposure, brightness, contrast, tones, sharpness etc., the Photographer(s) judgement regarding these corrections shall be deemed correct. The Photographer(s) cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record digitally the exact colour as seen by the human eye. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Retouching, digital manipulation and artist finishing is available to the Client as an option at extra cost.

c) The Photographer(s) shall be granted artistic license in relation to the poses photographed and the locations used. The Photographer(s) judgment regarding the location, poses and number of photographs taken shall be deemed correct. The Photographer(s) shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the Photographer(s) on the occasion of leaving somebody out.

d) The Photographer(s) is the only authorised and official photographer for your wedding day. Client(s) agree to give the photographer precedence over the guests in order to take the photographs required for the wedding services described above. The Photographer(s) cannot be held liable for a lack of wedding photos if guests taking their own photos of the clients continually interrupt the photographer’s work

e) For a booking involving a church ceremony or at certain venues, the Photographer(s) movements are sometimes restricted by the official in charge. The area from which the Photographer(s) is able to cover the ceremony may not be the Photographer(s) choice and the Photographer(s) cannot accept responsibility for any obstructed view should this be the case.

f) In cases where the wedding does not run on time (for example, extreme lateness by one of the clients arriving to the church) the Photographer(s) cannot guarantee to take their normal set of photos although in such circumstances the Photographer(s) will do their absolute best to compensate.

g)  Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the Photographer(s) will not be responsible for photographs that are not produced due to technical failure.

h) In the event that the Photographer Maddy Bennett is unable to attend the wedding booking then a suitable replacement that I deem to be of similar quality and style will be sourced and provided at no extra cost to the client(s).


3. Copyright: The copyright to these images is held by Maddy Bennett Photography. You may not use the images for commercial purposes. No Derivative Works – You may not alter, transform or build upon these images.


4. Display: The client(s) hereby allow(s) the Photographer(s) to display any photograph covered by this contract and to generally promote Maddy Bennett Photography in advertising, brochures, sample albums, magazine articles, websites, social media and other such material.


5. Payments:

a) A non-refundable booking fee of:

50% of invoice total (paid by cash, cheque or bank transfer) will confirm your booking.

b) Payment in full of the remaining balance will be 30 days before the date of the shoot.

c) All additional goods are at a separate cost from the booking fee and must be paid for in full on ordering. This includes prints, albums, and any other products or services ordered after the event.

d) Title to all goods remains with Madeleine Seaman / Maddy Bennett Photography until paid for in full by the client(s).


6. Complaints: any complaints must be received in writing within seven days of the receipt of products purchased. This includes photographs, discs, albums, frames and any other special services that have been agreed.


7. Force Majeure:

a) The due performance of the contract is subject to alteration or cancellation by the Photographer(s) owing to any cause beyond their reasonable control (e.g. sudden illness/injury/victim of crime or accident).

b) In the event of cancellation by the Photographer(s), or in the unlikely event of total photographic failure (although re-shoots may be arranged if practicable) – the Photographer(s) will not be responsible for costs in order to stage re-shoots. The Photographer(s) liability shall be limited to a full refund of any deposits and fees paid.


8. Digital Files:

a) The digital files shall remain the property of the photographer(s) and shall be kept for not less than 12 months from the shoot date at one site.

b) Should digital files be lost, damaged or destroyed the photographer(s) liability shall be limited to a pro-rata refund of fees paid, but shall not include a refund for any goods already supplied. No refund will be due for any negatives or digital files lost, damaged, or destroyed after 12 months from the date of the shoot.

c) All orders (albums, coffee table books, prints, frames) should be placed with the photographer(s) before the end of a 3 month period starting at the shoot date. The photographer(s) will not be liable for failure to produce any orders placed after this time.

d) RAW files will not be given to the client(s).


9. Cancellation and Rescheduling: If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:

a) Weddings – Cancellation from the booking date and more than three months to go until the wedding, the 50% booking deposit. Cancellation with less than three months to go, full price for the complete photographic coverage booked.

b) All other photographic shoots – Cancellation with less than a week to go until the shoot date will incur the full price of the session fee.


10. Placing an Order and Receipt of Goods:

a) Any alterations to orders must be notified either by phone or email and confirmed in writing within three working days of the order being placed. The photographer(s) will not be held liable for any costs incurred due to alterations to the order made by the client after this time.

b) If you place a print order this may take up to four weeks to complete. Allow 28 days for delivery of other orders. Where you choose to design an album through Maddy Bennett Photography you will be notified of the estimated completion date on a case by case basis.

c) The Photographer(s) must be notified either by telephone or email and confirmed in writing within three working days of the client(s) being in receipt of their order in the case of error, shortage or damage as mistakes cannot be rectified after this period.

d) Due to the nature of the product the Photographer(s) are unable to give exchanges or refunds. This does not affect your statutory rights.


11. Privacy: Madeleine Seaman / Maddy Bennett Photography may store your data on a private internal database. This data will not be made available to outside companies or individuals. Should you wish to have your data removed from the database, please advise in writing and retain your confirmation.


12. Governing Law: Any contract made between the Photographer(s) and the client(s) shall in all respects be governed by and construed in accordance with English Law and the parties hereto submit to jurisdiction of the English courts.
